Harbours Board Article 35 Penzance Harbour Revision Order 2009 Cornwall Council: Statutory Harbour Authority for Penzance Harbour Notice of Intention to sell, break up or otherwise dispose of vessels NOTICE IS HEREBY GIVEN that Cornwall Council (‘the Council’) as statutory harbour authority for Penzance Harbour intends to exercise its powers under article 35 of the Penzance Harbour Revision Order 2009 to sell, break up or otherwise dispose of the following vessels which have been left in an unserviceable condition, laid by or neglected in Penzance harbour: 1. Arkin Castle, former MFV 2. Independent, former MFV 3. La Nina, sailing yacht 4. Kylami, sailing yacht Any person who is the Owner of the any of the above vessels should write to the Harbour Master, Penzance Harbour, North Arm, Wharf Road, Penzance, TR18 4AH, confirming ownership and any action he intends to take. Any such response should be made in writing and received by the Harbour Master before the expiry of a period of 14 days starting with the date at the foot of this notice. Following the expiration of the 14 day period, the Council will sell, break up or otherwise dispose of the vessels. Under article 35(3) If the proceeds of sale are insufficient to reimburse the Council for its expenses in relation to doing so (and any expenses incurred under section 57 of the Harbour, Docks, Piers and Clauses Act 1847), or there is no sale, the Council may recover the deficiency, or, where there is no sale, the whole of the expenses, from the Owner as a simple contract debt.
